国内置业所需文件

需要有不动产的权属证明(房地产权证、房屋所有权证等)、约定不动产所有权转移的合同(买卖、赠与合同等)、履行合法交易手续的证明(契税、营业税完税证明等),如出售方系法人,还应提供同意出售证明等。


需要有交易双方的身份证明(视其主体不同,自然人需要提供身份证、军官证、士兵证、护照、回乡证、台胞证等,法人需要提供营业执照影本,组织机构代码证和税务登记证等)、交易双方的基本资讯(填写房地产变更登记申请表),如果自然人中一方不能亲自到场的,可以委托代理人代为办理过户手续,但代理人应当提供经过公证的授权委托书和代理人的身份证明,如果法人委托代理人代办过户手续的,应当提供加盖公司公章、法定代表人章的授权委托书和代理人的身份证明。


所谓禁止规定,指的是由于国家地方政策的规定,禁止该类不动产的交易,如某些花园住宅被列为保护建筑不允许交易,不动产在市政规划的红线内不允许交易等。


Documents Required for Home Ownership in Mainland China

Proof of ownership of the real estate (real estate certificate, property ownership certificate, etc.), contract for the transfer of ownership of the real estate(sale and purchase, gift contract, etc.), proof of fulfilment of legal transaction procedures (deed tax, the certificate of corporate tax, etc.) are major required documents. If the seller is a legal person, he/she is required to provide the proof of consent to the sale, etc.

 

Proof of identity for both transaction parties is required(depending on the subject, natural persons are required to provide identity cards, military officer cards, soldier cards, passports, Mainland Travel Permits for Hong Kong and Macau Residents and Mainland Travel Permits for Taiwan Residents, etc., while legal persons are required to provide copies of business licences, organisation code certificates and tax registration certificates, etc.), basic information of both parties to the transaction (fill in the real estate change registration application form). If either one of the natural persons cannot be present in person, an agent can be entrusted to handle the transfer procedures on his/her behalf, but the agent should provide the company’s common  seal, a legal stamp, power of attorney and proof of identity of the agent.

 

The so-called prohibition refers to the prohibition of trading particular categories of the real estate due to local policies in China, e.g. protected structures including certain garden houses and the real estate within the red line of municipal planning, are not allowed to be traded etc.
